Terms of Service
Last updated [Effective date]
The short version
- Designing your poster is free. You only pay when you order a print.
- Every poster is made to order, so there are no change-of-mind returns.
- If it arrives damaged or defective, or shows a detail that doesn’t match the shows you confirmed, we reprint it free.
- The artwork is AI-generated. You own your print and can hang it and share photos of it, but not sell copies.
This summary is for convenience. The full terms below are what apply.
These terms are an agreement between you and Concert Keepsake Co. (“we”, “us”), a small business based in [State], USA. By creating an account or placing an order, you agree to them. Please read them along with our Privacy Policy.
1. What we do
You tell us about concerts you’ve been to. We research the details, generate an original poster design around them, and, if you order, have it printed and shipped to you. You must be at least 18 years old, or the age of majority where you live, to place an order.
2. Your account
You sign in with an emailed link or with your Google account. Keep access to that email or account secure, because anyone who can open it can use yours. An account is for one person. During early access, sign-in may be limited to people we’ve invited.
3. What you give us
You keep ownership of what you tell us: your shows, notes and choices. You give us permission to use them, and to pass them to the service providers named in our Privacy Policy, to research your shows and make, print and deliver your poster. Please don’t submit anything unlawful, hateful or that you don’t have the right to share. We may decline to research or print anything we believe breaks these terms.
4. Research and your show record
We research your shows from public sources, such as setlist archives and news reports, and do our best to get them right. Those sources can be wrong or incomplete, and so can we. Before we design anything, you review and confirm your show record. You’re responsible for checking it: the poster is built from exactly what you confirm.
5. Your poster design
Your poster’s artwork is generated from scratch by AI image models, following our own design direction, in the tradition of historical poster styles. It is not made, endorsed or approved by the artists, estates or studios associated with those styles.
Band, artist, venue and festival names appear on your poster only to describe shows you attended. They belong to their owners, and nothing on your poster means they endorse or are connected with us or you.
Previews are watermarked and shown at reduced size. Each poster comes with a set number of designs (currently three), and we may change that number. AI output varies, and a design can contain small imperfections. You see your design before you order, and a person checks it before it prints.
6. Who owns what
You own the physical print you buy. We give you a permanent, personal license to display it, and to share photos and videos of it, including on social media. You may not sell, reproduce or commercially use the design, prints or copies of it, not least because the names on it belong to other people.
We keep any rights that exist in the design itself (AI-generated images may not be protected by copyright at all). Each design is one of one: we won’t sell your design to anyone else, and we won’t use it in our marketing without your permission.
The Concert Keepsake Co. name, website, software and our own materials belong to us.
7. Orders and payment
Prices are shown in US dollars before you pay and include shipping. Payment is taken by Stripe; we never see your full card number. If your country charges import duties or taxes, they are covered in the next section.
Your order is accepted when we email you to confirm it. We may cancel an order and refund you in full before it prints, for example if a price was shown in error or the order breaks these terms. Because each poster is printed to order, it can’t be cancelled once it has gone to print. If you need to change something, email us straight away.
8. Shipping
Shipping is free. Your poster is printed by our production partner at the lab nearest you (currently in the United States, the United Kingdom, the Netherlands and Australia) and shipped rolled in a rigid tube, unframed. We ship to the countries offered at checkout.
Delivery times are estimates, not guarantees, and depend on the carrier and your country. We’ll email you tracking details when your poster ships. Please check your shipping address carefully: if a poster is returned or lost because the address was wrong, we can send a replacement for what it costs us to print and ship it.
If your poster ships from a lab in another country, your country may charge import duties or taxes on arrival. Unless they were collected at checkout, they are yours to pay.
9. Reprints and refunds
Every poster is made for one person, so we don’t accept returns or give refunds if you change your mind. Instead, we reprint your poster free if:
- it arrives damaged;
- it has a printing defect; or
- it shows a detail that doesn’t match the show record you confirmed, such as a misspelled band name.
Email [support email] within 30 days of delivery with your order details and a photo of the problem. You don’t need to send the poster back. If your parcel hasn’t arrived within 30 days of its estimated delivery date, tell us and we’ll trace it or reprint it. If we can’t put a problem right with a reprint, we’ll refund what you paid for that poster.
Screens and paper show color differently, so small color differences between your preview and your print aren’t defects. Nothing in these terms takes away rights you have under consumer law where you live.
10. Using the service fairly
Please don’t misuse the service: don’t scrape it, overload it, get around its limits, access other people’s accounts or data, reverse-engineer it, or use it to break the law. We may suspend or close accounts that do. You can stop using the service at any time and ask us to delete your account.
11. Disclaimers
Apart from the promises we make in these terms, and to the extent the law allows, the service is provided “as is”, without other warranties of any kind, including fitness for a particular purpose. We don’t promise the service will always be available or free of errors.
12. Limits on our liability
To the extent the law allows, we’re not liable for indirect, incidental or consequential losses, and our total liability for any claim about the service or an order is limited to the amount you paid us for the order it concerns (or US $100 if you haven’t paid us anything). Some places don’t allow these limits, so they may not apply to you. Nothing here limits liability that can’t be limited by law.
If you break these terms or submit content you had no right to share, and that leads to a claim against us, you agree to cover our reasonable costs of dealing with it.
13. Changes
We may update these terms as the service grows. We’ll change the date at the top, and tell you by email or on the site before a significant change takes effect. The terms in place when you ordered apply to that order.
14. Disputes and governing law
If something goes wrong, email us first and give us 30 days to put it right; most problems are solved that way. These terms are governed by the laws of the State of [State], USA. Any dispute that can’t be resolved informally will be decided by the state or federal courts in [County], [State], except that either of us may bring a claim in small claims court. If you live outside the United States, you keep any protections that your local law gives consumers and that can’t be waived by agreement.
15. The rest
If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we haven’t given up the right to. You may not transfer your rights under these terms; we may transfer ours as part of selling or reorganizing the business. These terms and our Privacy Policy are the whole agreement between us about the service.
